Terms of Service

"We", "us" and "our" refer to Aussie Step. Aussie Step operates this store and website, including all related content, features, products and services (the "Services"). Our store is powered by Shopify.

These Terms of Service, together with the policies referenced in them, set out your rights and responsibilities when you use the Services. Please read them carefully — they include disclaimers and limits on our liability. By visiting or using the Services you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

1. Access and account

By agreeing to these Terms you confirm you are at least 18 years old, or that you have the consent of a parent or guardian to use the Services. You may be asked to provide information such as your email address and billing, payment and shipping details. You agree that the information you give us is correct, current and complete, and that you are entitled to provide it.

You are responsible for keeping your account credentials secure and for activity on your account. You may not transfer, sell or licence your account to anyone else.

2. Our products

We have made every effort to represent our products accurately. Colours and appearance may vary depending on your screen and device settings, and product photography is indicative only.

Product descriptions may change at any time without notice. We may discontinue a product, or limit the quantity available to any person or region, at our discretion.

3. Orders

When you place an order you are making an offer to purchase. We may accept or decline an order at our discretion, and your order is not accepted until we confirm it and have received your payment. Please check your order before submitting it — once an order is accepted we may not be able to change or cancel it. If we decline, change or cancel an order, we will contact you using the details you provided.

Returns and exchanges are handled under our Refund Policy. Purchases are for your own personal or household use, not for commercial resale or export.

4. Prices and payment

All prices are in Australian dollars (AUD) and include GST where applicable. Prices, discounts and promotions may change without notice; the price that applies is the one shown at the time you place your order and confirmed in your order email. Unless stated otherwise, prices do not include duties or import charges for orders shipped outside Australia.

Promotions may be governed by their own terms; where those conflict with these Terms, the promotion terms apply to that promotion. You agree to keep your payment and contact details current, and you confirm that you are authorised to use the payment method you provide and that the charges will be honoured.

5. Shipping and delivery

Delivery times are estimates, not guarantees. We are not responsible for delays caused by carriers, customs processing, or other events outside our control. Risk in the products passes to you once they are delivered to the carrier, without affecting your rights under the Australian Consumer Law if goods arrive damaged or are not delivered.

6. Intellectual property

The Services — including trade marks, text, images, graphics, video, audio and their design, selection and arrangement — are owned by Aussie Step or its licensors and protected by Australian and international intellectual property laws.

You may use the Services for your own personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works from, publish, download, store or transmit any material from the Services without our written consent. Our names, logos and slogans are our trade marks and may not be used without permission. Shopify's marks belong to Shopify, and all other marks belong to their respective owners.

7. Third-party tools and links

The Services may give you access to tools, content or links operated by third parties, which we do not control or monitor. They are provided "as is" and without endorsement, and your use of them is at your own risk. Please read the third party's own terms and policies. Questions or complaints about third-party products and services should be directed to that third party. New features we add to the Services form part of the Services and are covered by these Terms.

8. Relationship with Shopify

Aussie Step is powered by Shopify, which enables us to provide the Services to you. Any sale or purchase you make in our store is made directly with Aussie Step. You acknowledge that Shopify is not responsible for any aspect of a sale between you and us, including any injury, damage or loss resulting from products purchased, and you release Shopify and its affiliates from claims arising from your transactions with us.

9. Privacy

Personal information we collect through the Services is handled in accordance with our Privacy Policy, and some information may also be handled under Shopify's privacy policy. Because the Services are hosted by Shopify, information you submit may be transmitted to and stored by Shopify and its service providers, including outside Australia.

10. Reviews and feedback

If you send us reviews, ideas, suggestions or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display it in any medium, including for commercial purposes such as marketing. You confirm you have the rights to the Feedback you send and that you have disclosed any incentive you received for providing it.

We are not obliged to keep Feedback confidential, pay for it, or respond to it, and we may edit or remove Feedback we consider unlawful, misleading, offensive or in breach of these Terms. Your Feedback must not be defamatory, obscene, misleading, infringe anyone's rights, or contain malicious code, and you must not misrepresent who you are. You are responsible for the Feedback you submit.

11. Errors and omissions

Occasionally information on the Services may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges, delivery times or availability. We may correct errors and update information at any time, and may cancel an order affected by an error — including after you have submitted it — in which case we will refund you in full.

12. Prohibited uses

You may use the Services for lawful purposes only. You must not use them: for any unlawful or malicious purpose; to breach any law; to infringe our or anyone else's intellectual property; to harass, abuse, defame or harm any person; to send false or misleading information; to send spam or unsolicited promotional material; to impersonate anyone; or in any way that restricts another person's use of the Services.

You also must not upload viruses or malicious code; copy, resell or exploit any part of the Services; collect other people's personal information; phish or attempt to deceive users; use robots, scrapers, data-extraction tools or automated agents to access the Services; or bypass any security or access measures we use. We may suspend or terminate your account without notice if you breach these Terms.

13. Termination

We may terminate this agreement or your access to the Services at any time at our discretion, and you remain liable for amounts owing up to that date. The sections covering intellectual property, feedback, termination, disclaimers, limitation of liability, indemnity, severability, governing law and privacy survive termination.

14. Disclaimers

Information on the Services is provided for general information only. We do not warrant that it is accurate, complete or useful, and any reliance on it is at your own risk.

Except as expressly stated by us, and subject to the consumer guarantees under the Australian Consumer Law, the Services are provided "as is" and "as available" without warranties of any kind, and we do not guarantee that your use of the Services will be uninterrupted, secure or error-free.

15. Limitation of liability

To the extent permitted by law, and other than liability that cannot be excluded under the Australian Consumer Law, neither Aussie Step nor our directors, employees, contractors, service providers or licensors (nor Shopify and its affiliates) are liable for any indirect, incidental, special or consequential loss, including lost profits, lost revenue, lost data or replacement costs, arising from your use of the Services or any product purchased through them.

Where liability cannot be excluded but may be limited, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.

16. Indemnity

You agree to indemnify Aussie Step, Shopify and our respective affiliates, officers, employees, agents and service providers against any loss, damage, liability or claim, including reasonable legal costs, arising from your breach of these Terms, your breach of any law or another person's rights, or your use of the Services. We will notify you of any such claim and may control its defence at your expense, and you agree to cooperate; we will not settle a claim imposing non-monetary obligations on you without your consent.

17. General

If any provision of these Terms is found to be unlawful or unenforceable, it is severed and the remaining provisions continue to apply. Our failure to enforce a right is not a waiver of it. These Terms, together with the policies posted on this site, are the entire agreement between you and us and supersede any earlier agreements or versions. Headings are for convenience only.

You may not assign or transfer these Terms without our written consent; we may assign them without notice to you.

18. Governing law

These Terms are governed by the laws of Australia and the state in which Aussie Step is based. You and we submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth courts of Australia.

19. Changes to these Terms

The current version of these Terms is always available on this page. We may update or replace any part of them by posting the change here, and material changes take effect on the date stated in the notice. Continuing to use the Services after a change means you accept it.
